Products can be defective in design, in manufacturing, or because of inadequate warnings. Each theory has its own proof requirements.
Three Types of Defects
Strict Liability Standard
Wisconsin recognizes strict product liability under Wis. Stat. § 895.047, allowing recovery when a defective and unreasonably dangerous product causes injury. You don't have to prove the manufacturer was careless — only that the product was defective and unreasonably dangerous.
Who Can Be Liable
Manufacturers, distributors, and sometimes retailers can be responsible. Preserving the product itself is critical evidence.
